For occupant buyers
Obligation to occupy the housing unit bought and to be a resident there for a period of 10 years starting with the handing over of the keys. The owner may, under certain conditions:
- Rent out the housing unit after a minimum of 36 months of personal occupation and after having obtained the agreement of the BRDA on the basis of a written and supported request (conditions of rental below);
- Re-sell the housing unit after having submitted a complete dossier. The BRDA has 60 days to rule concerning the conformity of the dossier and the exercise of its right of pre-emption (conditions of re-sale below).
For investor buyers
Obligation to rent out or to re-sell the housing unit required while respecting the conditions below during 10 years starting from the handing over of the keys.
Rental Conditions
Maximum monthly rent = 1/12 of a return of 6.5% per year of the subsidised sales price (1) and index linked starting from the date of the official deed. The subsidised sales price includes the legal fees, VAT and the registration fees. For the calculation of the rent or of the re-sale price the amount of any modifications and/or improvements made to the housing will not be taken into account.
Tenants must meet the same access conditions as the occupant buyers (except for the fact that they may be owners of a property whose non-indexed cadastral income is higher than 745 € insofar as it is located outside of the Brussels-Capital Region).
Submission of a copy of the lease to the BRDA.
Conditions of re-sale
- Maximum price = price of subsidised sale + annual interest at the deposit facility rate of the Central European Bank. The subsidised re-sale rate includes the legal fees, VAT and registration fees. For the calculation of the rent or the re-sale price, the amount of any modifications and/or improvements made to the housing will not be taken into account. - Compliance with the conditions of access for occupants or investors, depending on the case.
- Right of pre-emption of the BRDA;
- Submission of a copy of the sales agreement and of the official deed of sale to the BRDA.
Monitoring and sanctions
- Monitoring of the amount of rent directly with the tenant;
- Monitoring of the annual domiciliation via the national register number.
IN THE EVENT OF FAILURE TO RESPECT THE CONDITIONS OF THE BRDA, THE FULL REIMBURSEMENT OF THE SUBSIDY TO THE BRUSSELS-CAPITAL REGION WILL BE DEMANDED.
End of the BRDA conditions
Ten years after the handing over of the keys, the owners are no longer subject to the conditions of the BRDA.
